Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Colliers Wood provides gardening and related outdoor maintenance services to domestic and commercial customers. By requesting a quotation, making a booking, or allowing our team to carry out work, you agree to be bound by these terms. Please read them carefully before confirming any service.

1. About Our Services

Gardeners Colliers Wood provides a range of gardening services, which may include lawn care, hedge trimming, planting, seasonal tidy-ups, pruning, weeding, garden clearance, soft landscaping, and general outdoor maintenance. The exact scope of work will be agreed in advance and may be set out in a quotation, booking summary, or written service description. We aim to provide services to properties in Colliers Wood and the surrounding area, although availability may vary depending on schedule, access, and the nature of the work requested.

We reserve the right to decline work that is unsafe, impractical, unlawful, outside our skill set, or otherwise unsuitable. Any advice we provide about plant care, garden maintenance, or improvements is given in good faith, but final decisions remain the customer’s responsibility unless we expressly agree otherwise in writing.

2. Booking Process

A booking is usually made following an enquiry and a review of the requested work. Where necessary, we may ask for photographs, a site visit, measurements, or further details before providing a quotation or confirming availability. Any quotation given is based on the information available at the time and may change if the actual site conditions differ from those described.

A booking is only confirmed when we have accepted the job and, where required, received any deposit or advance payment requested. We may confirm bookings in writing or by other recorded means. If the customer requests changes to the agreed work after booking, we may revise the price, timing, or staffing requirements.

The customer must ensure that we have accurate information about the property, access arrangements, pets, hazards, parking restrictions, water supplies, and any other relevant matters. If we arrive and are unable to proceed because access is restricted, the site is unsafe, or necessary information was not provided, we may charge a call-out fee or the full booked amount where reasonable.

3. Quotations and Prices

Unless otherwise stated, quotations are valid for a limited period and may be withdrawn or revised after that time. Prices may be quoted as a fixed fee, hourly rate, day rate, or based on the size and condition of the garden. Any estimate is not a guarantee unless we explicitly confirm it as a fixed-price agreement.

Our prices may change if the scope of work changes, hidden conditions are discovered, extra labour or materials are required, or access is delayed. We will aim to notify you before carrying out additional chargeable work wherever possible. If immediate action is needed to protect health, safety, or property, we may carry out the necessary work and charge for it reasonably.

4. Payments

Payment terms will be confirmed at the time of booking or on the invoice. Unless agreed otherwise, payment is due upon completion of the service or within the period stated on the invoice. For larger projects, we may request a deposit, staged payments, or payment in advance for materials.

If payment is not made on time, we may suspend further work, cancel future bookings, and recover reasonable costs associated with late payment. We reserve the right to charge interest and any lawful debt recovery costs on overdue sums. Any bank charges, failed payment fees, or transfer costs caused by the customer’s chosen method of payment may be charged to the customer where permitted by law.

All prices are stated inclusive or exclusive of any applicable VAT as confirmed at the time of quotation or invoicing. If VAT applies, it will be shown separately where required.

5. Cancellations and Rescheduling

If you need to cancel or reschedule a booking, please provide as much notice as possible. We understand that weather and access conditions can affect gardening work, and we may need to rearrange appointments for safety or practical reasons. Where we cancel due to weather, unsafe conditions, illness, equipment failure, or other operational issues, we will offer a new date where reasonably possible.

If the customer cancels after accepting a booking, we may charge a cancellation fee to cover administrative costs, reserved labour, materials purchased, or lost time. The amount charged will depend on how much notice was given and whether any preparatory work has already been carried out. If cancellation is made at short notice or on the day of service, a full or partial charge may apply.

If the customer is not present for a scheduled visit and no prior arrangement has been made for access, we may treat the appointment as cancelled and charge accordingly. Repeated cancellations or repeated failure to provide access may result in refusal of future bookings.

6. Customer Responsibilities

The customer is responsible for ensuring that the property is accessible and reasonably safe for the work to be carried out. This includes removing or securing valuables, warning us of underground services or hidden hazards, and advising us of any fragile items, irrigation systems, or protected plants that require special care. The customer should also ensure that children, pets, and other occupants are kept away from the work area while we are on site.

Where keys, access codes, parking arrangements, or concierge access are provided, the customer is responsible for ensuring they are correct and available at the agreed time. We are not responsible for delays caused by incomplete access arrangements supplied by the customer or their representative.

7. Materials, Plants, and Waste

Any plants, compost, soil, decorative materials, chemicals, or other goods we supply remain payable once ordered or delivered, unless otherwise agreed. Where suitable, we may use customer-supplied materials, but we do not accept responsibility for defects, suitability, or performance of items supplied by the customer.

We will remove garden waste only where this has been agreed in advance or is included in the service. Waste may include grass cuttings, branches, leaves, soil, green waste, and general garden debris. We will handle waste in accordance with applicable UK waste regulations and expect customers to disclose if waste includes anything unusual, contaminated, or potentially hazardous. Waste disposal charges may apply and can vary depending on quantity, weight, and disposal method.

The customer must not ask us to dispose of waste that is illegal, hazardous, contaminated, or outside the scope of ordinary garden waste without prior written agreement. This includes asbestos, chemicals, fuel, oil, gas cylinders, clinical waste, building rubble, electrical items, or other regulated materials. If such materials are discovered during a job, we may stop work and request further instruction or specialist assistance.

8. Waste Regulations and Environmental Compliance

We aim to dispose of garden waste responsibly and in line with environmental and waste handling obligations. Where required, waste may be taken to authorised transfer stations, recycling facilities, composting facilities, or other lawful disposal sites. We may separate recyclable green waste from general waste where practical and commercially sensible.

Customers are responsible for informing us if the garden has been affected by invasive species, plant disease, contamination, or any material that may require special handling. Additional charges may apply where disposal is subject to extra treatment, segregation, or certification. If the customer requests that waste be left on site, they are responsible for ensuring that this is lawful and appropriate for the property and local rules.

9. Liability and Limitations

We will carry out services with reasonable care and skill. If we cause loss or damage as a result of proven negligence, we will, at our discretion, repair the damage, re-perform the service, or provide reasonable compensation, subject to the limits set out in these terms. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded under UK law.

We are not responsible for pre-existing defects, hidden damage, deterioration caused by age or weather, or problems arising from conditions that were not reasonably visible before work started. This includes but is not limited to fragile fencing, broken paving, weak roots, underground services, hidden obstructions, or damaged irrigation systems. We are also not liable for delays or failures caused by events outside our reasonable control, including severe weather, traffic disruption, supplier delays, strikes, or acts of third parties.

Any plants we prune, cut back, move, or transplant are handled based on our professional judgement unless the customer gives clear written instructions. We cannot guarantee the survival, growth, flowering, or recovery of plants, lawns, or turf because many outcomes depend on weather, soil conditions, pests, and previous care. Any advice provided about treatment, irrigation, or future maintenance is general guidance only and does not constitute a guarantee.

10. Complaints and Aftercare

If you are unhappy with any part of the service, please raise the issue as soon as reasonably possible so we can investigate and, where appropriate, return to assess the matter. Claims relating to workmanship, damage, or omissions should be reported promptly and with reasonable detail. We may ask for photographs or access to the site to review the issue.

We will consider complaints fairly and aim to resolve them by agreement wherever possible. We are not obliged to accept claims made long after the work was completed, especially where the condition of the garden may have changed due to weather, routine use, lack of watering, or third-party interference.

11. Ownership and Risk

Any goods or materials supplied by us remain our property until paid for in full, where lawful. Once work has been completed and the customer has accepted the service, the risk in the work passes to the customer, except where loss or damage is caused by our negligence or by a matter for which we remain legally responsible.

12. Use of Subcontractors and Staff

We may use employed staff, approved subcontractors, or other suitable professionals to carry out all or part of the service. Where subcontractors are used, we remain responsible for the standard of the service we have agreed to provide, subject to these terms. We may change personnel where needed to manage schedules, expertise, or operational requirements.

13. Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or operational practices. The version in force at the time your booking is accepted will apply to that booking unless a change is required by law or agreed in writing.

14. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising from them or in connection with them, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales will have exclusive jurisdiction, except where consumers have any mandatory rights to bring proceedings in another competent court under applicable law.

15. General Provisions

If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force. Any failure by us to enforce a right or provision does not constitute a waiver of that right or provision. These terms form the entire agreement between us and the customer in relation to the services booked, unless varied in writing by both parties.
